Terms of Service
These Terms of Service ("Terms") govern your use of the Merus website (merusmat.com), member platform (members.merusmat.com), and mobile and TV apps (together, the "Service"), operated by Merus Mat LLC ("Merus," "we," "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility
You must be at least 18 years old to create an account. By using the Service, you represent that you are 18 or older and able to enter a binding contract.
2. Your account
You are responsible for your login credentials and for all activity under your account. Keep your password secure and notify us at contact@merusmat.com of any unauthorized use. Accounts are personal and may not be shared or resold.
3. Membership and billing
Merus is a paid subscription service. Current pricing: $18 per month or $175 per year, plus any applicable taxes. Prices are shown at checkout before you subscribe.
Automatic renewal. Your membership renews automatically at the end of each billing period (monthly or annual) and your payment method is charged at the then-current rate until you cancel. Your renewal date is shown in your account settings.
Free trial. New memberships begin with a 7-day free trial. You will not be charged until the trial ends. Cancel before the trial ends to avoid any charge. Any unused portion of a free trial is forfeited when a paid period begins.
How to cancel. You can cancel anytime in your account settings at members.merusmat.com, effective at the end of your current billing period. If you subscribed through the Apple App Store or Google Play, your billing is managed by that store and you must cancel through your device's subscription settings.
Refunds. See our Refund & Cancellation Policy below on this page, which is part of these Terms.
Price changes. We may change pricing with at least 30 days' notice by email. Price changes take effect at your next renewal. If you don't agree, cancel before the new price applies.
4. License to use the Service
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to stream and view Merus content for your own personal, non-commercial use. You may not download (except through in-app features we provide), copy, record, redistribute, publicly perform, sell access to, or use Merus content to teach or provide services to others. All content, trademarks, and software on the Service are owned by Merus Mat LLC or its licensors and protected by law.
5. Member content and community
If the Service includes community features, you may post comments or other content ("Member Content"). You retain ownership of your Member Content and grant Merus a worldwide, royalty-free license to host, display, and reproduce it in connection with operating and promoting the Service. You agree not to post content that is unlawful, harassing, hateful, sexually explicit, misleading, infringing, spam, or medical advice. We may remove Member Content or suspend accounts at our discretion. We do not endorse Member Content and are not responsible for it.
6. Copyright complaints
We respond to copyright notices under the Digital Millennium Copyright Act. See our Copyright Policy below on this page for the notice procedure and our designated agent.
7. Health disclaimer and assumption of risk
The Service provides fitness content, not medical advice. Our Health & Fitness Disclaimer below on this page is part of these Terms. By using the Service, you acknowledge that exercise carries inherent risks, you voluntarily assume those risks, and, to the fullest extent permitted by law, you release Merus Mat LLC, its members, employees, and instructors from liability for injuries or damages arising from your participation in workouts or use of the Service.
8. Acceptable use
You agree not to: interfere with or disrupt the Service; access it by automated means; circumvent access controls or content protections; frame or mirror the Service; reverse-engineer the apps; or use the Service for any unlawful purpose.
9. Third-party services
The Service is delivered using third-party providers, including Uscreen (video platform) and payment processors such as Stripe, and may be purchased through the Apple App Store or Google Play. Those services have their own terms, and purchases made through app stores are also subject to the store's terms and refund policies.
10. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not guarantee uninterrupted or error-free service, or any particular fitness results.
11. Limitation of liability
To the fullest extent permitted by law, Merus Mat LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Merus Mat LLC and its members, employees, and instructors from claims, damages, and expenses (including reasonable attorneys' fees) arising from your Member Content, your violation of these Terms, or your misuse of the Service.
13. Dispute resolution: arbitration and class-action waiver
Please read this section carefully. Any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in San Diego County, California, or remotely by video. You and Merus each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing contact@merusmat.com within 30 days of first accepting these Terms, stating your name, account email, and intent to opt out.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. For disputes not subject to arbitration, you and Merus consent to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
15. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your account if you violate these Terms, with or without notice. Sections 4, 7, and 10 through 14 survive termination.
16. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will notify you by email or in the Service before they take effect. Continued use after the effective date constitutes acceptance.
Privacy Policy
This Privacy Policy explains how Merus Mat LLC ("Merus," "we," "us") collects, uses, and shares personal information when you visit merusmat.com, use our member platform at members.merusmat.com, use our mobile or TV apps, or communicate with us (together, the "Service").

1. Information we collect
Information you provide. Account details (name, email address, password), payment information (processed by our payment providers; we do not store full card numbers), communications you send us, and content you post in community features.
Information collected automatically. Device and browser type, IP address, pages viewed, workouts watched, watch time, app activity, and approximate location derived from IP address, collected through cookies and similar technologies. See our Cookie Policy below on this page.
Information from third parties. If you subscribe through the Apple App Store or Google Play, we receive subscription status from the store but not your payment details.
2. How we use information
We use personal information to: provide and operate the Service; process subscriptions and payments; personalize content and remember preferences; send transactional emails such as receipts and account notices; send marketing emails if you have signed up (you can unsubscribe anytime); respond to support requests; analyze usage to improve workouts and features; prevent fraud and abuse; and comply with legal obligations.
3. How we share information
We do not sell your personal information for money. We share information only with:
Service providers. Companies that operate parts of the Service on our behalf, including Uscreen (video and membership platform), payment processors such as Stripe, Squarespace (website hosting), email service providers, and analytics providers such as Google Analytics. They may use your information only to provide services to us.
Advertising partners. We may use advertising tools such as the Meta Pixel and Google advertising services, which collect information about your activity through cookies. Under California law, this kind of sharing for cross-context advertising may be considered "sharing," and you can opt out as described in Section 6.
Legal and safety. When required by law, to enforce our Terms, or to protect the rights, safety, or property of Merus, our members, or others.
Business transfers. In connection with a merger, acquisition, or sale of assets, in which case this Policy will continue to apply to your information.
4. Cookies and analytics
We use cookies and similar technologies for essential site functions, analytics, and advertising. Details, including how to manage cookies, are in our Cookie Policy below on this page. We honor Global Privacy Control (GPC) signals as an opt-out of sharing where required by law.
5. Your choices
Marketing emails. Unsubscribe using the link in any marketing email. Transactional emails (receipts, account notices) are sent regardless.
Account information. Update your details in your account settings at members.merusmat.com, or contact us for help.
Cookies. Manage preferences through your browser settings and the tools described in the Cookie Policy.
6. Your California privacy rights
If you are a California resident, the California Consumer Privacy Act (CCPA/CPRA) gives you the right to: know the categories and specific pieces of personal information we collect and how we use and share them; request deletion of your personal information; request correction of inaccurate personal information; opt out of the sale or sharing of personal information; limit use of sensitive personal information; and not be discriminated against for exercising these rights.
To exercise these rights, email contact@merusmat.com with "Privacy Request" in the subject line, or use the "Your Privacy Choices" link in our website footer to opt out of sharing. We will verify your request using your account email and respond within the time required by law. You may designate an authorized agent to submit requests on your behalf.
In the last 12 months, we have collected the categories of personal information described in Section 1, used them for the purposes in Section 2, and disclosed them to the categories of recipients in Section 3. We do not knowingly sell personal information of consumers under 16.
7. Other regions
If you access the Service from outside the United States, your information is processed in the United States. Where the EU or UK General Data Protection Regulation applies, our legal bases for processing are performance of our contract with you, our legitimate interests in operating and improving the Service, your consent where required (such as marketing), and legal compliance; and you may have rights to access, correct, delete, restrict, or port your personal data and to lodge a complaint with your local supervisory authority. 8. Data retention and security
We keep personal information for as long as your account is active and as needed for the purposes described in this Policy, to meet legal obligations, or to resolve disputes, then delete or de-identify it. We use reasonable administrative, technical, and physical safeguards to protect personal information, though no method of transmission or storage is completely secure. If a breach affecting your personal information occurs, we will notify you as required by law.
9. Children's privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.
10. Changes to this Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page with a new effective date, and if changes are material, we will notify you by email or in the Service.

1. What cookies are
Cookies are small text files placed on your device when you visit a website. They help sites function, remember preferences, and understand how visitors use them. Similar technologies include pixels, tags, and local storage; we refer to all of these as cookies in this Policy.
2. Types of cookies we use
Essential cookies. Required for the site and member platform to work: signing in, keeping your session active, processing checkout, and remembering security settings. These cannot be switched off.
Analytics cookies. Help us understand how visitors use the site, such as which pages are viewed and how people move through them, so we can improve the Service. We use tools such as Squarespace Analytics and Google Analytics.
Advertising cookies. Used to measure ad performance and show relevant ads on other platforms. We may use tools such as the Meta Pixel and Google advertising services. Global Privacy Control. We honor GPC browser signals as an opt-out of the sharing of personal information where required by law.

We may update this Cookie Policy as our use of cookies changes. Updates will be posted on this page with a new effective date.

Cancellation
Policy
1. Free trial
Every new membership starts with a 7-day free trial. You will not be charged until the trial ends. Cancel during the trial and you will not be billed.
2. Cancel anytime
Cancelling stops your next billing cycle. You keep full access through the end of the period you've paid for.
3. No partial refunds
We do not refund unused time in a billing period.
4. Subscribed on merusmat.com?
Cancel in your account settings at members.merusmat.com.
5. Subscribed through Apple or Google?
Your billing is managed by that store. Cancel in your device's subscription settings. Refunds for store purchases are handled by Apple or Google under their policies, not by Merus.
6. Annual memberships
Not right for you? Email contact@merusmat.com within 14 days of your first annual charge ($175) for a full refund. First charge only, not renewals.
7. Auto-renewal
Memberships renew automatically until cancelled ($18/month or $175/year). Your renewal date is shown in your account settings, and every charge gets an emailed receipt.

1. Not medical advice
Merus provides fitness content for general informational purposes only. It is not a substitute for care from a physician or qualified health provider.
2. Talk to your doctor first
Consult your physician before starting this or any exercise program, especially if you are pregnant or postpartum, have a medical condition, are managing an injury, or are experiencing symptoms related to perimenopause or menopause.
3. Never ignore medical advice
Never ignore professional medical advice or delay seeking it because of something you saw on Merus.
4. You participate at your own risk
Exercise carries an inherent risk of injury.
5. Work within your limits
If you feel pain, dizziness, shortness of breath, or discomfort, stop immediately and seek medical attention.
6. Results vary
References to strength, mobility, or bone health describe the general benefits of exercise and are not a promise of specific results.
Copyright
Policy
Merus respects the intellectual property rights of others and expects members to do the same. We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).
1. Reporting infringement
If you believe content on the Service infringes your copyright, send a written notice to our designated agent including: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and its location on the Service; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
